Common use of Projected capacity Clause in Contracts

Projected capacity. Approximate starting date of the construction and duration thereof. Within ninety (90) days counted as from the date of the notice, the other Party, through a written notice, shall be entitled to decide whether it participates in the projected additional facilities. In the event said Party chooses not to participate in the additional facilities, or does not reply to the proposal of the participating Party, hereinafter called the constructor Party, the latter may proceed with the additional facilities and order the Operator to construct, operate and maintain said facilities at the exclusive expense and risk of the constructor Party, without prejudice to the normal development of the Joint Operations. The constructor Party may negotiate with the other Party the use of said facilities for the Joint Venture. During the time that the facilities are operated for the account and risk of the constructor Party, the Operator shall charge it for all the operating and maintenance costs of the additional facilities in accordance with the generally accepted accounting standards.
