Project Drawings. Project drawings which are developed by Consulting Engineer/Architect through the use of a Computer Aided Drafting (CAD) System shall be made available to City by providing a Microsoft compatible compact disc. However, due to the potential that the information set forth on the electronic media (disk) can be modified by City, or City consultants, unintentionally or otherwise, Consulting Engineer/Architect shall remove all indices of its ownership, professional corporation name, seal, and/or involvement from each electronic display. For documentation purposes, two sets of an original electronic media (disk) and two (11" x 17" size or larger) duplicate hard copy sets will be prepared. One set will be given to City and one set will be retained by Consulting Engineer/Architect. If City provides such electronic media (disk) to others for any purpose, City shall require the electronic media (disk) to be returned to City upon completion of such use. City recognizes that use of such electronic media (disk) will be at City's sole risk and without any liability risk or legal exposure by Consulting Engineer/Architect.

Upon conclusion of the project and before final payment, the Professional shall provide the City with reproducible drawings of the project containing accurate information on the project as constructed. Drawings shall be of archival, prepared on stable Mylar base material using a non-fading process to provide for long storage and high quality reproduction. "CD" disc of the as-built drawings shall also be submitted to the City in an AutoCAD version no older then the established city standard.

However, due to the potential that the information set forth on the electronic media (disk) can be modified by Owner, or Owner’s consultants, unintentionally or otherwise, Design/Builder shall remove all indices of its ownership, professional corporation name, seal, and/or involvement from each electronic display. For documentation purposes, two sets of an original electronic media (disk) and two (11" x 17" size or larger) duplicate hard copy sets will be prepared. One set will be given to Owner and one set will be retained by Design/Builder. If Owner provides such electronic media (disk) to others for any purpose, Owner shall require the electronic media (disk) to be returned to Owner upon completion of such use. Owner recognizes that use of such electronic media (disk) will be at Owner's sole risk and without any liability risk or legal exposure by Design/Builder.
Project Drawings. Upon completion of the preliminary engineering studies and analysis and documentation as set forth in Section 1.1 of this Schedule A, Pathnet shall deliver to Incumbent the following project drawings: (i) a System layout drawing, (ii) the rack profiles, (iii) block drawings, and (iv) equipment wiring drawings (collectively, the "Project Drawings.")

However, due to the potential that the information set forth on the electronic media (PDF files) can be modified by City, or City consultants, unintentionally or otherwise, Consulting Landscape Architect shall remove all indices of its ownership, professional corporation name, seal, and/or involvement from each electronic display. Accordingly, the electronic documents provided to the City are for informational purposes only and are not intended as an end-product. The Consulting Landscape Architect makes no warranties, either expressed or implied, regarding the fitness or suitability of the electronic documents. Accordingly, the City agrees to waive any and all claims against the Consulting Landscape Architect and the Consulting Landscape Architect’s Architects relating in any way to the unauthorized use, reuse or alteration of the electronic documents. For documentation purposes, two sets of an original electronic media (PDF files) will be prepared. One set will be given to City and one set will be retained by Consulting Landscape Architect. If City provides such electronic media (PDF files) to others for any purpose, City shall require the electronic media to be returned to City upon completion of such use. However, due to the potential that the information set forth on the electronic media could be modified by City, or other City consultants, unintentionally or otherwise, Consultant will remove all indices of its ownership, professional corporation name, seal, and/or involvement from each electronic display. If City provides such electronic media to others for any purpose, City will require the electronic media to be returned to City upon completion of such use. City recognizes that use of such electronic media will be at City's sole risk and without any liability risk or legal exposure by Consultant.

"CD" disc of the record drawings shall also be submitted to the owner in and AutoCAD version no older then the established City standard. The Professional acknowledges the City is a governmental entity subject to the Colorado Open Records Act, C.R.S. §§ 24-72-200.1, et seq. (the “XXXX”), and documents in the City’s possession may be considered public records subject to disclosure under the XXXX.
Project Drawings. Cause the preparation of any necessary revisions to the Project Drawings and deliver such revisions to Owner for its review and approval to the extent required by Section 4(u) of this Agreement.
