The Progress Milestones clause defines specific stages or benchmarks that must be achieved during the course of a project or contract. Progress Milestones. 4.1.1. Overall Freeport progress milestones will be set out by DLUHC and will be agreed with all Freeports. In cases where a progress milestone is not applicable to the Freeport, DLUHC will mutually agree a revision or completion of that particular milestone with the Freeport. 4.1.2. Each request for a Working Capital Loan hereunder shall constitute a representation and warranty by the Borrower to the Lender that all conditions to the making or conversion of such Loan, as applicable, have been satisfied, unless such conditions have been waived in writing by Lender.

The Governing Body is accountable to HMG for delivery of Parkside, 3MG and Wirral Waters, including optimising development of tax sites which: Aligns with the LCR Freeport’s target sectors of aerospace, maritime, energy, automotive, bio manufacturing, chemicals, food & drink, and fast-moving consumer goods objectives (including logistics), and vision as set out in the FBC; Would not have occurred without LCR Freeport tax site status and is not displaced from elsewhere in the UK unless clearly demonstrating growth either through larger, improved premises or more employment or the safeguarding of UK operations; and Occurs within the period for most Freeport tax reliefs (i.e. prior to October 2026)11 To achieve this, the Governing Body will: Uphold the Liverpool City Region Freeport Gateway and Northside Gateway policies in the Management Case of the FBC, ensuring that the business activities of any occupier which wishes to take advantage of the Business Rates Relief and other allowances are in line with the objectives for the Freeport, aligned to key sectors and in line with displacement objectives. Monitor and report to DLUHC on compliance with the aforementioned LCR Freeport Gateway policies; Exercise the incentives and discretionary use of retained business rates and other LCR Freeport-related support in relevant scenarios of non compliance as defined in the Commercial Case of the FBC; Monitor and report to DLUHC on the delivery of the tax sites listed in the FBC as part of the formal data reporting requirements, as set out in Section 6 of this MoU; and Inform DLUHC of any delays to the delivery of the tax sites.
