The Professional Design clause establishes the requirement that all design work performed under the agreement must meet recognized professional standards and be executed by qualified individuals. Typically, this clause applies to architects, engineers, or other design professionals, ensuring that their work complies with applicable laws, codes, and industry best practices. Its core function is to assure the client that the design services provided will be competent and reliable, thereby reducing the risk of errors, defects, or non-compliance in the final deliverables.
Professional design. Proposed designs for new or expanded breakwaters, jetties, and groins shall be designed by qualified professionals, including both an engineer and a biologist.
Professional design. The following applies to each Order which includes any design services (“Design Services”) performed by the Vendor: (a) all Design Services shall be performed in accordance with all good architectural and engineering practices and with all applicable laws, codes, regulations, and industry standards; and (b) without limiting the Vendor’s obligations or the Purchaser’s rights and remedies, the Vendor must obtain Errors & Omissions insurance with limits not less than $2,000,000 per claim and with an aggregate limit of not less than $2,000,000. The Vendor agrees to maintain this coverage for six (6) years following after the final delivery of Work. Prior to providing Design Services, the Vendor must provide a certificate of such insurance to the Purchaser.
