Production Covenant. Commencing February 3, 2011 (the “Commencement Date”), and thereafter during the Term hereof, Contractor shall mine and deliver to Owner at the Point of Delivery, during normal business hours, such quantities of Clean Coal as Owner shall specify pursuant to Section 3.3 below. As used herein, the term “Clean Coal” shall mean Coal meeting the quality specifications set forth in Exhibit 2 which is attached hereto and made a part hereof by this reference (the “Specifications”)
Production Covenant. Commencing August 1, 2014 (the “Commencement Date”), and thereafter during the Term hereof, Contractor shall mine and deliver to Owner at the Point of Delivery, during normal business hours, such quantities of pure Pozzolan as Owner shall specify pursuant to Section 3.3 below. As used herein, the term “Pure Pozzolan” shall mean Pozzolan meeting the quality specifications as determined by Owner and agreed to by Contractor (the “Specifications”).
