Product Yield. CLIENT acknowledges and agrees that, due to the unpredictable nature of biological processes, Product yield cannot be guaranteed and may vary.
Product Yield. Without limiting any of Licensee's rights under Section 8.3(c), Licensee acknowledges that the output from each full batch size of 4,000 Units will likely be in the range of eighty percent (80%) to one hundred percent (100%) of the batch size and the delivery of Products in such range shall not be deemed a breach of this Agreement.
Product Yield. Yield shall be defined as pounds of feedstock as defined in Article 3.03.01 required to yield one U.S gallon of ASTM D 6751-03 quality biodiesel as measured during steady state operating conditions. To achieve Substantial Completion, the Project must demonstrate that the plant can achieve the minimum yield of no less than one gallon of acceptable biodiesel per 8.20 pounds of feedstock.
Product Yield. Pegasus Project parts shall achieve an Integrated Test Yield ("ITY") of at least sixty-five (65%) percent in accordance with the Specifications in Exhibit R. For the purposes of this Agreement, ITY shall mean the number of fully functional, full specification packaged parts expressed as a percentage of the total die produced by the integrated circuit fab. In addition, at least eighty-five (85%) percent of the Pegasus Project parts (measured on a monthly basis) which are packaged must pass all specified functional and electrical tests.
Product Yield. Yield shall be defined as pounds of feedstock as defined in Article 3.03.01 required to yield one U.S gallon of ASTM D 6751-03 quality biodiesel as measured during steady state operating conditions. Based upon analytical testing, pilot plant operations and completed mass balances, this feedstock is expected to yield between 7.80 and 8.00 pounds of feedstock per gallon of biodiesel, however, BSF will make all reasonable efforts to improve this yield during plant commissioning. To achieve Substantial Completion, the Project must demonstrate that the plant can achieve the minimum yield value of 8.00 pounds per gallon.
