Product Evaluation. The Employer’s Product Improvement Committee will continue to review and evaluate medical devices that reduce or help prevent employee exposure to blood and/or body fluids. The Committee’s evaluation of products will include consideration of cost, applicability and effectiveness, with applicability and effectiveness being primary considerations.
Product Evaluation. Under this criterion the Hospital shall evaluate the supplied sample with its technical specification to confirm whether the sample meet the Hospital specification. NB Only bids that qualify at Product Evaluation stage 2B above shall proceed to financial/price evaluation.

THE DEADLINE FOR SAMPLE SUBMISSION IS THE DAY BEFORE OPENING NB Only bids that qualify at Product Evaluation stage 2B above shall proceed tofinancial/price evaluation.
Product Evaluation. Company shall evaluate each Product to determine if it conforms, in all material respects, to the Specifications. Company shall give Jabil written notice of any rejection of a Product within ten (10) business days following Company’s receipt of such Product (“Evaluation Period”). Such written notice of rejection of a Product for failure to materially conform to the Specifications shall include a detailed and complete description of Company’s basis for asserting that the Product does not materially conform to the Specifications (“Specification Notice”). If Company fails to provide such Specification Notice to Jabil within the Evaluation Period, such Product shall be deemed to comply with the Specifications. If Jabil disputes the basis for rejection set forth in a Specification Notice, it shall provide written notice of the same to Company within ten (10) business days following receipt of the Specification Notice (“Notice of Disputed Defect”). Any such dispute shall be resolved by the Parties in accordance with the provisions of Section 21.13. Any specified times for delivery of such Products set forth herein shall be tolled during the dispute resolution procedure set forth above. If Jabil does not dispute the basis for rejection set forth in a Specification Notice Jabil shall follow its standard return process as set forth in Section 5.2 herein. The evaluation procedures set forth in this Section 4.7 shall apply to any redelivered Product.
Product Evaluation. Acceptance of the Product will occur upon Company’s or its designee’s receipt of the Product. Notwithstanding the foregoing, Company reserves the right to inspect or evaluate any Product to determine if it conforms, in all material respects, to the Specifications. In the event Company determines that the Product does not pass its acceptance test procedures or inspection procedures, (i) Company shall notify Jabil in writing that such Product is a Non-Conforming Product, and (ii) Jabil will assume its obligations and Company will have the available remedy with respect to such Non-Conforming Products as set forth in Section 5.4. For the avoidance of doubt, the Jabil Warranty in Section 5 will survive any acceptance, inspection, or evaluation by Company under this Section.
Product Evaluation. In all specifications, the words "or equal" are understood after each article when manufacturer's name or catalog are referenced. If bidding on items other than those specified, the bidder must, in every instance, give the trade designation of the article, manufacturer's name and detailed specifications of the item the bidder proposes to furnish; otherwise, the bid will be construed as submitted on the identical commodity described in the detailed specifications. The Purchasing Agent reserves the right to determine whether or not the item submitted is the approved equal the detailed specifications.
Product Evaluation. Acceptance of the Product will occur upon iRobot’s or its designee’s receipt of the Product. Notwithstanding the foregoing, iRobot reserves the right to inspect or evaluate the Product to determine if it conforms, in all material respects, to the Specifications, either at Kin Yat’s premise or third party location. Given reasonable and adequate advance notification to Kin Yat and by appointment, iRobot may, at its discretion, perform inspections of the Product at random or on a continual basis, on site at Kin Yat’s premises. In the event that the Product does not meet the Specifications, such Product will be deemed Non-Conforming and iRobot will have all available remedies with respect to Non-Conforming Products as set forth in this Agreement. Acceptance, inspection or evaluation by iRobot does not relieve Kin Yat of its obligations to the services and warranties as set forth in this Agreement.
Product Evaluation. From time to time, in its sole discretion, ECHELON may offer VAR the opportunity to receive new or modified versions of hardware or software Products prior to their commercial release by ECHELON (“Pre-Release Products”), at no charge or for such charge as ECHELON may specify. VAR may, but shall have no obligation to, accept ECHELON’s offer receive Pre-Release Products. If VAR elects to receive any Pre-Release Products, then the following terms shall apply:
Product Evaluation. If the Products are provided for evaluation purposes without payment to Qumulo or a Reseller then the Products shall be governed by the signed Evaluation Agreement between the parties.
Product Evaluation. The Authority, in performing such QA activities as might be necessary, may at its expense, submit components or assemblies for critical testing examination to Independent Laboratories or Test Houses.
