Producing Designated Record Set and Access by Patients to their PHI. To the extent that the BA possesses or maintains PHI in a Designated Record Set, within fifteen (15) days of a written request from the CE, the BA will make available to the CE PHI in a designated record set as necessary to satisfy the CE’s obligations under 45 CFR 164.524 and Section 13405(e) of HITECH. Alternatively, if the BA receives a request directly from the patient or his/her authorized representative, the BA shall provide the designated record set within the time frames provided in 45 CFR 164.524.
