Privacy & Security. Customer must have and enforce a privacy policy that complies with all applicable laws, rules and regulations including without limitation the treatment of all personal information in accordance with European Union and other non-U.S. applicable laws and governing authorities to the extent that Customer sells into international marketplaces or otherwise is subject to the laws of those authorities. Customer must secure buyer information and not allow buyer information to be disclosed except in accordance with Customer’s privacy policy. Customer must establish security processes to protect personal information in accordance with applicable law and at least as restrictive as industry standards, but no less than reasonable care. Customer acknowledges that Customer’s information and Customer’s buyers’ information (personal or otherwise) may be transmitted to the United States or European Union and other non-U.S. jurisdictions as a result of ChannelAdvisor providing the Services. In accessing the ChannelAdvisor Platform as permitted under the Agreement, Customer must report any security breaches promptly to ChannelAdvisor. Customer is responsible for any breaches of security that occur through Customer’s access or login credentials of the ChannelAdvisor Platform. Each user must have his or her own login credentials; only one user may use the same login credentials. In cases in which the Data Protection Law of the European Union applies to the provision of Services to Customer, the parties will comply with the data protection agreement terms located at: xxxx://xxx.xxxxxxxxxxxxxx.xxx/terms/dpa. For the purposes of this Section 3.3, applicable Data Protection Law has the meaning attributed to this term at the foregoing URL.

Privacy & Security. Invoice Cloud's privacy and security policies may be viewed at xxxx://xxx.xxxxxxxxxxxx.xxx/privacy.html. Invoice Cloud reserves the right to modify its privacy and security policies in its reasonable discretion from time to time which modification shall not materially adversely impact such policies. Invoice Cloud will maintain compliance with current required Payment Card Industry (PCI) standards and Cardholder Information Security standards.
Privacy & Security. You agree that we may exchange your information with the Digital Wallet provider, a payment network (e.g., Visa and Mastercard), and others in order to enable your use of the Digital Wallet, make information available to you about your Card transactions, and improve our ability to offer the Digital Wallet services. For purposes of this Clause 10, applicable privacy and security laws mean and include all applicable Laws protecting the personal data and privacy of natural persons, including in particular, the European General Data Protection Regulation 2016/679 ("GDPR") and its implementing national data protection laws as well as any subsequent applicable legislation that may amend or replace, re-enact or consolidate any of them; and the terms “Personal Data” and “Personal Data Breach” have the same meaning as under the GDPR.

Customer may not retain personal information for any period longer than necessary to complete the applicable transaction, and Customer must establish security processes to protect personal information in accordance with applicable law and at least as restrictive as industry standards, but no less than reasonable care. Customer acknowledges that Customer’s information and Customer’s buyers’ information (personal or otherwise) may be transmitted to the United States or European jurisdictions as a result of ChannelAdvisor providing the Services. Customer must ensure that Customer’s privacy statement discloses the use of “cookies” or similar technologies that may be used by Customer or a third party (including ChannelAdvisor) to track browsing and purchasing habits. Customer must comply with all applicable laws concerning “cookie” disclosures to consumers, including any opt in and opt out requirements. In accessing the ChannelAdvisor Platform as permitted under the Agreement, Customer must report any security breaches promptly to ChannelAdvisor. Customer is responsible for any breaches of security that occur through Customer’s access or login credentials of the ChannelAdvisor Platform.
Privacy & Security. (a) The Company is and has (i) been in compliance in all material respects with applicable Data Protection Requirements; and (ii) developed, implemented, and conducted its business in material compliance with any public privacy notices and data security or privacy policies and procedures (copies of which have been made available to Buyer). The Company has not, in the past five years, been subject to or received any claims, notices, or written complaints regarding the Company’s information practices or alleging a violation of any individual’s privacy rights from any Person or any other Governmental Entity or received any written (or to the knowledge of Seller Parties, oral) subpoenas, demands, or other notices from any Governmental Entity or any other party investigating, inquiring into, or otherwise relating to any violation of any Data Protection Requirements, and to the knowledge of Seller Parties, no such action is threatened against the Company.

Civil Code § 1798.100 et seq., (“CCPA”) and the following terms will apply: (a) ChannelAdvisor at all times under the Agreement is acting as Customer’s Service Provider and has been engaged by Customer for the Business Purpose of providing the Services detailed in the Agreement; (b) ChannelAdvisor will not Sell Personal Information it handles in connection with the Services;
