Principal Developer Documents Clause Samples
The 'Principal Developer Documents' clause defines the set of documents, plans, or materials that the principal developer is required to prepare, maintain, or provide under the agreement. Typically, this includes architectural drawings, technical specifications, progress reports, and other project-related documentation necessary for the development process. By clearly identifying and regulating these documents, the clause ensures that all parties have access to accurate and up-to-date information, thereby facilitating project coordination and reducing the risk of misunderstandings or disputes.
Principal Developer Documents. Except with the Department’s prior written approval in its good faith discretion, Developer shall not (a) terminate or permit the termination of a Principal Developer Document except in the case of material uncured default or (b) agree to any amendment of any provision of a Principal Developer Document required by the Department as specified in Section 7.3.2 or elsewhere in this Agreement, or agree to any amendment thereof inconsistent with the terms of the Contract Documents. The foregoing does not, however, affect Developer’s rights with respect to any Refinancing set forth in Section 15.4.
