Primary Defined Terms. As used below in this Agreement, the following capitalized terms have the meanings set forth in this Section unless the context expressly requires otherwise:
Primary Defined Terms. When used in this agreement and capitalized, unless the context clearly indicates otherwise, these terms shall have these special meanings: BANKRUPTCY PROCEEDING: the consolidated bankruptcy proceedings of the Chapter Subsidiaries, begun on August 14, 1995, when each of the Chapter Subsidiaries filed a petition for reorganization under chapter 11 of the Bankruptcy Code, and pending in the U.S. Bankruptcy Court for the Northern District of Texas, Dallas Division, as In re Automobile Credit Fund 1991-III, Inc., et al, case nos. 395-34981-RCM-11 through 395-34988-SAF-11, jointly administered under case no. 395-34981-RCM-11. BANKRUPTCY CODE: the United States Bankruptcy Code, as amended from time to time.
