The Price Level clause establishes the baseline or reference price for goods or services under a contract. It typically specifies how the initial price is determined, such as by referencing a published index, market rate, or agreed-upon figure, and may outline mechanisms for future adjustments. This clause ensures both parties have a clear understanding of the starting price, reducing the risk of disputes and providing a transparent basis for any price changes during the contract term.
Price level. Each Product offering is assigned a point value on the Product List and is assigned to one of the following pools: applications, systems, and servers. In order for Registered Affiliates to qualify for academic level pricing and be eligible to acquire Licenses from any particular pool under this agreement, Institution must select that pool on the attached Academic Select Volume Forecast Form and represent to Microsoft that Institution reasonably expects its Registered Affiliates, in the aggregate, to acquire from that pool, during the initial term of this agreement. Institution’s price level will be used to determine the prices Microsoft will invoice each Registered Affiliate’s Reseller for Product Licenses that Registered Affiliate orders.
