Prevail Clause Samples

The "Prevail" clause establishes which terms or provisions take precedence in the event of a conflict between different parts of a contract or between related documents. In practice, this clause typically specifies that the main agreement will override any inconsistent terms found in attachments, schedules, or referenced documents. By clearly designating which terms control, the clause ensures consistency and prevents disputes over which provisions should be followed, thereby promoting clarity and reducing the risk of conflicting interpretations.
