Post Test Modifications Clause Samples
Post Test Modifications. If prior to Substantial Completion of a Unit:
(a) an Acceptance Test has been completed;
(b) a certificate of completion of such Acceptance Test has been issued pursuant to Section 13.7;
(c) Contractor or any Subcontractor makes any modification to such Unit; and EXECUTION COPY (d) such modification could have had a material effect on the outcome of such Acceptance Test, if it had been made before the completion of such Acceptance Test, then such Acceptance Test shall be re-run, as a condition to achieving Substantial Completion for such Unit.
Post Test Modifications. If prior to Substantial Completion:
(a) an Acceptance Test has been completed;
(b) Contractor or any Subcontractor makes any modification to the Project; and
(c) such modification could have had a material effect on the outcome of such Acceptance Test, if it had been made before the completion of such Acceptance Test, then Contractor and Owner shall agree on an appropriate test of the modified components or such Acceptance Test shall be re-run, as a condition to achieving Substantial Completion.
Post Test Modifications. If prior to Biogas Substantial Completion or Substantial Completion, as applicable:
(a) A Performance Test has been Successfully Completed for the Plant;
(b) A certificate of completion of such Performance Test has been issued pursuant to Article 12.6.5; and
(c) Either Contractor or any Subcontractor makes any modification to the Plant, as the case may be; then, unless otherwise waived by Principal in writing, the Performance Test shall be a re-run as a condition to the Plant achieving Biogas Substantial Completion or Substantial Completion, as applicable.
