Post-Conviction Relief Clause Samples
The Post-Conviction Relief clause outlines the procedures and rights available to a defendant after a conviction has been entered. It typically allows the convicted individual to challenge the conviction or sentence through specific legal mechanisms, such as appeals, motions for a new trial, or petitions for habeas corpus. This clause ensures that individuals have a formal avenue to address potential errors or injustices that may have occurred during the trial, thereby safeguarding the fairness and integrity of the legal process.
Post-Conviction Relief. Pursuant to Idaho Code § 19-4904, Conflict Attorney agrees to act as court-appointed conflict counsel in any post-conviction relief case that may arise during the Attorney’s contract and representation of the client in which the attorney is appointed to by the Court. If the petitioner is alleging ineffective assistance of counsel, new counsel will be appointed by the appropriate Court rather than the original counsel in the underlying case.
Post-Conviction Relief. Pursuant to Idaho Code § 19-4904, Attorney agrees to act as counsel in any post-conviction relief case that may arise during the Attorney’s contract or in any case in which the Attorney is appointed. It is understood that in most post-conviction relief cases the defense attorney in the underlying criminal action is usually not re-appointed to represent the petitioner due to the fact that many times such cases raise claims of ineffective assistance of counsel; new counsel will be appointed hereunder based upon the month in which the appointment of counsel order is filed unless otherwise ordered by the Court.
Post-Conviction Relief agrees to act as legal counsel in any post-conviction relief proceeding that may arise and be assigned to him/her during the term of this Contract, or in any case in which the client assigned to him requests such work.
