Police Services. 8.9.1.1 Developer, without expense to TxDOT, shall permit the Texas Department of Public Safety and any other public law enforcement agency with jurisdiction to provide traffic patrol, traffic law enforcement and the other police and public safety services in accordance with applicable Laws and agreements with State and local agencies, including permitting at least the type and level of service that the Texas Department of Public Safety provides on Comparable Limited Access Highways owned and operated by TxDOT. In addition, Developer, without expense to TxDOT, shall engage, on mutually acceptable reasonable terms and conditions, either the Texas Department of Public Safety or another qualified public law enforcement agency with jurisdiction to provide enhanced levels of traffic patrol, traffic law enforcement services, special traffic operations services, accident assistance and investigation, and other enhanced police and Emergency services as needed due to any Developer-Related Entity’s construction, operation, maintenance or other activities on or affecting the Project.
8.9.1.2 Developer shall not engage, or otherwise permit the engagement of, private security services to provide traffic patrol or traffic law enforcement services on the Project unless otherwise approved by TxDOT in its sole discretion. Notwithstanding the foregoing, Developer may engage private security firms or employ passive security devices or technology to protect, collect, accumulate, transfer and deposit tolls and Incidental Charges or to identify toll violators; provided, however, that services to physically apprehend toll violators may be performed only by the Texas Department of Public Safety unless otherwise approved in writing by TxDOT in its sole discretion. In providing such policing services through a private security firm, Developer shall comply and cause the firm to comply with applicable Laws, including the regulations of the Texas Department of Public Safety. The foregoing does not in any way limit Developer’s enforcement of private rights and civil remedies respecting toll violations.
8.9.1.3 At Developer's request and expense, TxDOT shall assist Developer in securing the agreement of the Texas Department of Public Safety to perform enhanced services. Such assistance may include accompanying Developer to meetings with the Texas Department of Public Safety, requesting the involvement of the director of TxDOT and taking any other reasonable action within its powers.

Police Services. City shall provide police protection services to the Property on the same basis as is provided to other similarly situated residents and businesses in the City. Owner acknowledges the concurrent jurisdiction of the City police department and the Jasper County Sheriff on the Property and shall not interfere or in any way hinder law enforcement activities of either on the Property regardless of whether such may be a restricted access community.
Police Services. (a) Developer acknowledges that the Texas Department of Public Safety is empowered to enforce all applicable Laws and to enter the Project at any and all times to carry out its law enforcement duties. No provision of this Agreement is intended to surrender, waive or limit any police powers of the Texas Department of Public Safety or any other Governmental Entity, and all such police powers are hereby expressly reserved.
(b) TxDOT shall not have any liability or obligation to Developer resulting from, arising out of or relating to the failure of the Texas Department of Public Safety or any other public law enforcement agency to provide services, or its negligence or misconduct in providing services.
(c) TxDOT and third parties with responsibility for traffic regulation and enforcement shall have the right to install, operate, maintain and replace cameras or other equipment on the Project that relate to traffic regulation or enforcement. Developer shall coordinate and cooperate, and require its Contractors to coordinate and cooperate, with any such installation, maintenance and replacement activities.
Police Services. 4.1.15.1.1 DB Contractor acknowledges that the Texas Department of Public Safety is empowered to enforce all applicable Laws and to enter the Project or Maintenance Limits at any and all times to carry out its law enforcement duties. No provision of this CMC is intended to surrender, waive or limit any police powers of the Texas Department of Public Safety or any other Governmental Entity, and all such police powers are hereby expressly reserved.
4.1.15.1.2 TxDOT shall not have any liability or obligation to DB Contractor resulting from, arising out of or relating to the failure of the Texas Department of Public Safety or any other public law enforcement agency to provide services, or its negligence or misconduct in providing services.
4.1.15.1.3 TxDOT and third parties with responsibility for traffic regulation and enforcement shall have the right to install, operate, maintain and replace cameras or other equipment on the Project that relate to traffic regulation or enforcement. DB Contractor shall coordinate and cooperate, and require its Subcontractors to coordinate and cooperate, with any such installation, maintenance and replacement activities.

3.2.1.2. TxDOT shall not have any liability or obligation to DB Contractor resulting from, arising out of or relating to the failure of the Texas Department of Public Safety or any other public law enforcement agency to provide services, or its negligence or misconduct in providing services.
3.2.1.3. TxDOT and third parties with responsibility for traffic regulation and enforcement shall have the right to install, operate, maintain and replace cameras or other equipment on the Project that relate to traffic regulation or enforcement. DB Contractor shall coordinate and cooperate, and require its Subcontractors to coordinate and cooperate, with any such installation, maintenance and replacement activities.

6.11.1.1 Developer shall, among other things, permit, without expense to IFA, the Indiana State Police, and any other public law enforcement agency with jurisdiction to provide traffic patrol, traffic law enforcement and the other police and public safety services on or for the O&M Limits in accordance with applicable Laws and agreements with State and local agencies, including permitting at least the type and level of service that the Indiana State Police provides on Comparable Facilities owned and operated by the Department. Developer shall, as a material obligation hereunder, permit such law enforcement agencies to provide such law enforcement assistance services. In addition, Developer, without expense to IFA, may engage, on mutually acceptable reasonable terms and conditions, either the Indiana State Police or another qualified public law enforcement agency with jurisdiction to provide enhanced levels of traffic patrol, traffic law enforcement services, special traffic operations services, accident assistance and investigation, and other enhanced police and Emergency services as needed due to any Developer-Related Entity’s construction, operation, maintenance or other activities on or affecting the O&M Limits.
6.11.1.2 Developer shall not engage, or otherwise permit the engagement of, private security services to provide traffic patrol or traffic law enforcement services on the O&M Limits unless otherwise approved by IFA in its sole discretion.
6.11.1.3 At Developer's request and expense, IFA shall assist Developer in securing the agreement of the Indiana State Police to perform enhanced services on or for the O&M Limits. Such assistance may include accompanying Developer to meetings with the Indiana State Police, requesting the involvement of the Public Finance Director and taking any other reasonable action within its powers.
6.11.1.4 Nothing in this Section 6.11.1 shall be construed as conferring upon IFA in any way responsibility for funding enhanced policing services.
6.11.1.5 Developer acknowledges that the Indiana State Police is empowered to enforce all applicable Laws and to enter the O&M Limits at any and all times to carry out their law enforcement duties. 5.8.1.2 The Department and Developer shall not have any liability or obligation to each other resulting from, arising out of or relating to the failure of a public law enforcement agency to provide services, or its negligence or misconduct in providing services.
Police Services. 8.3.1 Developer acknowledges that any Governmental Entity empowered to enforce all Applicable Laws is free to enter the Project at any and all times to carry out its law enforcement duties. No provision of this Agreement is intended to surrender, waive or limit any police powers of any Governmental Entity, and all such police powers are hereby expressly reserved.
8.3.2 The Authority and Developer shall not have any liability or obligation to each other resulting from, arising out of or relating to the failure of a public law enforcement agency to provide services, or its negligence or misconduct in providing services (except, in the case of the Authority, the Authority Police); provided, that no failure by a law enforcement agency to provide services shall excuse Developer from performance of any of its obligations under this Agreement.
