Plowing Clause Samples
The Plowing clause defines the responsibilities and procedures related to the preparation and maintenance of land through plowing. Typically, it specifies which party is responsible for plowing, the timing and standards for the work, and any requirements for restoring the land to a certain condition. For example, in an agricultural lease, the tenant may be required to plow the fields before the end of the lease term to ensure the soil is ready for the next planting season. This clause ensures that the land remains productive and minimizes disputes over land condition at the end of an agreement.
Plowing a) Prior to the establishment of a snow pack on the roads and after break up of snowpack and where road gravel is evident in the roadway, the Contractor shall use its best efforts not to remove any of the existing road gravel. However, the Contractor cannot guarantee that some existing road gravel will not be removed during the normal course of plowing.
b) Need for plowing shall be determined by a four (4”) inch accumulation of snow evaluated at Town Hall, which site shall not be sheltered by trees nor particularly susceptible to drifting snow. The Contractor shall, in addition to the measurement at Town Hall be responsible for evaluating different areas of town Contractor shall be responsible for daily measurement of snowfall. However, the Town Manager or, in the Manager’s absence, the Manager’s designee, shall be the final arbitrator as to the determination of snow depth, and the Manager’s determination shall be binding in all respects.
c) Determine the need for plowing shall be made any time between the hours of 1:00 a.m. and 3:00 p.m. MDT. Removal operations shall begin within 1 hour of determination of need for plowing d) Failure to commence plowing within 2 hours of when there is a need for plowing as described above shall be considered Failure to Respond.
e) The Contractor shall use its best efforts to avoid the pushing and piling of snow into or onto residents' driveways in a manner that will prevent a common passenger vehicle from exiting or entering the driveway without additional efforts to remove the accumulation of snow. TheContractor shall also use its best efforts to keep from damaging trees and other property along the roadways and turnarounds.
Plowing. There shall be no tilling or plowing or use of the Protected Property for commercial cultivation of row crops.
Plowing. There shall be no tilling or plowing of the Protected Property, except as allowed under Section 4.8 herein.
Plowing. 1. All Primary routes shall be cleared to the Near Normal Mostly Clear condition, as shown in the following photographs, prior to suspending operations or otherwise instructed by the Public Works Director
2. All Secondary routes shall be cleared to the Partly Covered condition, as shown in the following photographs, prior to suspending operations or otherwise instructed by the Public Works Director.
3. Residential routes shall be plowed and left in a Covered condition, as shown in the following photographs, with an accumulation of less than 2-inches prior to suspending operations or otherwise instructed by the Public Works Director
4. All roads shall be in an acceptable condition before snow or ice removal operations are temporarily or finally suspended. The Public Works Director shall determine when roads are in an acceptable condition.
5. All vehicles shall follow City-approved pre-planned routes for effective coverage.
6. Vehicles shall not divert from the assigned routes except for emergencies coordinated with the fire department, ambulance service, Public Works Director or sheriff’s office.
7. Storm drainage inlets shall not be blocked by snow or ice removing activities.
8. Contractors are advised that the area south of Castle Pines Parkway bounded by Monarch Blvd. and Yorkshire Drive is a north facing slope with many large trees and will require additional attention during heavy snow and icing periods, especially during the cleanup phase of the snow and ice removal. Any north facing areas of the City may require additional time as directed by the Public Works Director.
Plowing. There shall be no tilling or plowing of the Protected Property except as required to improve conservation value.
Plowing. 7.1 Plowing innerduct includes the hauling of inner duct from storage area to work location and any handling required to properly install (via direct burying) the innerduct in the ground to a minimum depth of 48”, or in accordance with jurisdictional authorities. This includes coordination with utility owners in locating their facilities prior to the installation of the innerduct.
7.2 The equipment and construction methods used by the Contractor shall be such as to cause minimum displacement of the soil. The slot made in the soil by the cable plows shall be closed immediately by driving a vehicle track or wheel over the slot or by other suitable means.
7.3 Damage to banks, ditches, and roads caused by the equipment shall be immediately repaired and restored to original condition to the satisfaction of the jurisdictional authorities.
7.4 The Contractor shall promptly repair any damage to fences, lawns, shrubbery, drives, and any other property damaged during construction to original condition. After installation, the fiber optic cable shall be tested for sheath faults to ground by the Contractor.
7.5 The start pits, finish pits, and pits at points of intersections will be excavated in advance of plowing. Utility crossings will be exposed prior to start of plowing operations. The Contractor will exercise care in the use of trenching equipment and shovels in joining slots and/or trenches to other slots/trenches to be certain that the cable is not damaged.
Plowing. The Parties agree that OYA may plow seasonal or minimum maintenance roads along the Winter Access Route identified as Appendix A, as needed during or after construction of the Project. Nothing herein shall require the Town or County to plow seasonal or minimum maintenance roads during or after construction of this Project.
Plowing. The Parties agree that there shall be no plowing of seasonal or minimum maintenance roads during or after construction of the Project except upon the issuance of permission by the Municipal Highway Superintendent. In the event permission is granted, the Company shall give notice to any snowmobile club that has a groomed trail on that road that it will be plowing and shall post signs notifying snowmobilers that that portion of the trail has been plowed.
Plowing. The Parties agree that there shall be no plowing of seasonal or minimum maintenance roads during or after construction of the Project except upon the issuance of a special permit by the Town Highway Superintendent.
