PLATFORM DISCLAIMER. The parties acknowledge that errors may occur in the prices quoted by Company due to internet or connectivity failures or delays, price feed mistakes or otherwise resulting in quoted Prices materially deviating from market rates. In such circumstances, without prejudice to any rights either Company or the Client may have under common law, neither the Client nor Company will be bound by any Contract which purports to have been made (whether or not confirmed by Company) at a Price which was, or ought reasonably to have been, known to either the Client or Company to be materially incorrect at the time the Contract was entered into. Except for the case of fraud, Company shall not be liable for any loss or damage suffered by the Client as a result of the reliance of the Client on a Price which the Client knew, or ought reasonably to have known, to be materially incorrect. Company shall not permit any arbitrage practice or strategy designed to take advantage of price latency or other manifest errors and reserves the right to revoke any Contract entered into by the Client relying on such errors. Company shall be responsible for the regular updating of the Platform software.

YOU ACKNOWLEDGE AND AGREE THAT THE PLATFORM, THE CONTENT, AND THE SOFTWARE ARE PROVIDED ON “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS” BASIS AND WITHOUT WARRANTY OR CONDITION OF ANY KIND WHATSOEVER, AND YOUR ACCESS TO AND USE OF THE PLATFORM OR ANY OTHER HOMESTARS PROPERTY AND YOUR INTERACTION WITH ANY CUSTOMERS AND YOUR JOBS IS ENTIRELY VOLUNTARY AND AT YOUR OWN RISK AND LIABILITY.

HAZELDEN AND HAZELDEN’S PARTNERS PROVIDE ACCESS TO THE PLATFORM ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND MAKE NO REPRESENTATION, WARRANTY, PROMISE, OR GUARANTY THAT THE PLATFORM WILL BE AVAILABLE OR FULLY OPERATIVE AT ANY TIME OR ON AN UNINTERRUPTED OR ERROR-FREE BASIS. THE PLATFORM MAY CONTAIN ERRORS, GLITCHES, BUGS, OR OTHER DEFECTS, AND YOU AND YOUR SUBSCRIBER UNDERSTAND AND ACKOWLEDGE THAT YOUR AND YOUR SUBSCRIBER’S SOLE AND EXCLUSIVE RIGHT AND REMEDY IN THE EVENT OF YOUR OR YOUR SUBSCRIBER’S DISSATISFACTION WITH THE PLATFORM IS FOR YOU OR YOUR SUBSCRIBER TO NOTIFY HAZELDEN ABOUT ITS DISSATISFACTION WITH THE PLATFORM, IN WHICH CASE HAZELDEN WILL REVIEW THE COMPLAINT WITH HAZELDEN’S PARTNERS’ SUBJECT MATTER EXPERTS, AND/OR TO STOP USING THE PLATFORM, AND/OR TO TERMINATE THE AGREEMENT AT THE END OF YOUR SUBSCRIPTION OR YOUR SUBSCRIBER’S TERM IN ACCORDANCE WITH THE TERMINATION PROVISION OF YOUR SUBSCRIPTION OR YOUR SUBSCRIBER’S SUBSCRIPTION AGREEMENT.
PLATFORM DISCLAIMER. Without limiting Section 14 of the General Terms (Disclaimers), the Platform pro- vided by Vendor relies upon numerous interconnected communication and other technologies that are inherently not fault-free and may contain errors or become interrupted. Vendor disclaims responsibility for liabilities, losses, claims, and demands resulting from any such errors or interruptions. The Platform should not be used for fault-intolerant applications or where such errors or interruptions would present a high degree of risk. Certain Platform features allow alerts and notifications to be sent to mobile devices. Vendor is not responsible for text or other mobile communications charges resulting from such alerts and notifications or for alert failures due to failures of the mobile device or its connectivity. Vendor is not responsible for Platform errors due to Hardware or other equipment failure.
