Planned Community is a Private Undertaking Clause Samples

Planned Community is a Private Undertaking. It is agreed among the Parties that the Planned Community is a private development and that the City does not have any interest therein except as authorized in the exercise of its governmental functions. The Planned Community is not a joint venture, and there is no such relationship involving the City or the City’s elected or appointed officials, officers, employees, agents, representatives, engineers, or attorneys. Nothing in this Agreement shall preclude the Master Developer from forming any lawful form of investment entity for the purpose of completing any portion of the Planned Community.
