Common use of Persistent Failure to Pay Rent Clause in Contracts

Persistent Failure to Pay Rent. In addition to any other remedies available to Landlord pursuant to this Lease or by law, Landlord may, at any time throughout the Term of this Lease, terminate this Lease upon Tenant's default on three (3) separate occasions during any twelve (12) month period under subsection 20.1.a, regardless of whether or not such prior defaults have been cured. Termination, pursuant to this subsection 20.6, shall be effective upon Landlord's delivery to Tenant of a notice of termination.

In addition to any other remedies available to Landlord pursuant to this Lease or by law, Landlord mayupon an Event of Default under subsection 20.1.a., at any time throughout the Term of this Lease, terminate this Lease upon Tenant's default on three (3) separate occasions during any twelve (12) month period under subsection 20.1.aperiod, regardless of whether or not such prior defaults have been cured. Termination, pursuant Landlord shall have the right to this subsection 20.6declare the Default Rate applicable to late payments of Rent thereafter during the Term to be twice the amounts set forth in Section 6.5 (i.e., shall be effective upon Landlord's delivery to Tenant of a notice of termination10% and 20%).

In addition to any other remedies available to Landlord pursuant to this Lease or by law, Landlord may, at any time throughout the Term of this Lease, terminate this Lease upon Tenant's ’s default on three two (32) separate occasions during any twelve (12) month period under subsection 20.1.aSubsection 20.1.(a) of this Lease, regardless of whether or not such prior defaults have been cured. Termination, pursuant to this subsection Subsection 20.6, shall be effective upon Landlord's ’s delivery to Tenant of a notice of termination.

Termination, pursuant to this subsection 20.6, shall be effective upon Landlord's delivery to Tenant of a notice of termination.

Persistent Failure to Pay Rent. In addition to any other remedies available to Landlord pursuant to this Lease or by law, Landlord may, at any time throughout the Term of this Lease, terminate this Lease upon Tenant's default on three (3) separate occasions during any consecutive twelve (12) month period under subsection 20.1.aof the Term of this Lease, regardless of whether or not such prior subsequent defaults have been cured. Termination, pursuant to this subsection 20.6Section 18.5, shall be effective upon Landlord's delivery to Tenant of a notice of termination.

In addition to any other remedies available to Landlord pursuant to this Lease or by law, Landlord may, at any time throughout the Term of this Lease, terminate this Lease upon Tenant's ’s default on three (3) separate occasions during any consecutive twelve (12) month period under subsection 20.1.aof the Term of this Lease, regardless of whether or not such prior subsequent defaults have been cured. Termination, pursuant to this subsection 20.6Section 18.5, shall be effective upon Landlord's ’s delivery to Tenant of a notice of termination.
