For the purpose of determining whether Products are defective or non-conforming (resulting from faulty design, material and/or workmanship), Performance Guarantees that are specified in the Agreement or the PO are not achieved until the defect or non- conformity is remedied and the Products or services are performing within all specifications set forth in Attachment E.
