Performance Guarantee Clarification. For the purpose of determining whether Products are defective or non- conforming (resulting from faulty design, material and/or workmanship), Performance Guarantees that are specified in a SA and/or PO are not achieved until the defect or non-conformity is remedied and the Products or services are performing within all specifications set forth in the SA and/or PO.
