The Performance Control clause establishes the standards and mechanisms by which a party's performance under a contract is monitored and managed. Typically, this clause outlines specific metrics, reporting requirements, or review processes to assess whether obligations are being met, and may include provisions for corrective actions if performance falls short. Its core practical function is to ensure that both parties have a clear understanding of expectations and remedies, thereby reducing the risk of disputes and promoting accountability throughout the contract term.
Performance Control. NCCU and Performer will have joint control over the presentation and performance of the Performance. All recorded music played must be radio edited. Recorded music that contains vulgarity and/or obscenities may not be played. Performer shall maintain an awareness of the audience to ensure that any recorded music played will not be offensive. If Performer has a question about the acceptability of a song, Performer shall contact the NCCU Contract Administrator listed below.
Performance Control. For events held on Institution’s campus, Institution will reserve the exclusive right to control the event and Performance, including, but not limited to, stage announcements and the schedule of events. Institution reserves the right to immediately terminate the Performance, in whole or in part, if it determines, in its sole discretion, that such action is necessary to maintain security or ensure compliance with federal, state, and/or local laws and regulations, or Institution policies. Payment may be withheld upon such termination.
Performance Control. The systems of baningo GmbH are balanced in terms of load and designed redundantly as far as possible. They are based on several server stations that are able to compensate for a failure or defect. Our web and database servers are protected by firewalls and their use is documented in writing. Daily backups protect against data loss of personal data (data backup). Access authorizations differentiated according to confidentiality also protect personal productive data against accidental destruction, loss or misuse.
Performance Control. 6.1 The Supplier shall ensure that its quality control systems meet the quality requirements of any relevant customer of Cross (as notified to the Supplier by Cross from time to time) and as set out in the Purchase Order Requirements Manual (CMR1000) in its then current edition applicable on the day of issue of the Purchase Order. 6.2 The Supplier warrants that it shall not, in providing the Supply, infringe the intellectual property rights of any third party and further indemnifies Cross against all liabilities, costs, expenses, damages and losses suffered or incurred by Cross in connection with any claim made against Cross for actual or alleged infringement of a third party’s intellectual property rights arising out of or in connection with Cross’ use of Supply. 6.3 Throughout the provision of the Supply, and upon prior notice, the Supplier shall permit Cross and the representatives of any relevant official authorities or any relevant customer of Cross to have unlimited access, during business hours, to its premises and to any document for the purpose of verifying compliance with all applicable performance controls.
