Per Hr. The Council and the Provider will negotiate the appropriate banding(s) on an individual case-by-case basis according to the Service User’s needs and the Outcomes required. As a generality, the expectation is that Night Sleeping will most likely fall within the low activity band, Night Sitting and Day Sitting in the medium activity band, with 24 hour care possibly being a mix of two or all three bands.
6.9 The above prices are based on 2005/2006 prices and will be subject to an inflationary increase, agreed by the Council, when the Contract comes into effect on 3rd July, 2006.
6.10 The Provider shall provide the level of Service no greater than the agreed amount for the total number of Service Users they are Commissioned to provide Services for in accordance with each Service User’s allocated budget. This will allow the maximum degree of flexibility for each individual Service User. The Provider shall monitor the budget for each Service User and where it is found that during any four week cycle that the Services being provided equate to less than 90% of the allocated budget or is insufficient to meet the specified Outcomes and wishes of the Service User, the Provider shall contact the Council immediately. See Sub-paragraph 4.5. of Schedule 1 – Service Specification.
6.11 The Council reserves the right, in the case of a Service User needing specialist services, where the Service is outside the scope of the Provider’s Services, to seek the Service from a Specialist Agency, outside of this Contract.
6.12 The Contract Price will be reviewed by the Council as part of the Annual Review of the Contract as defined in Clause 3 Glossary of Terms.
