Payroll Dues Deduction. The Board shall, upon written authorization of the employee, deduct BTU-TSP dues. The BTU-TSP shall furnish, distribute and process assignment authorization forms, said forms to be filed by BTU-TSP with Human Resources & Equity. Employees who desire to become members of the BTU-TSP shall file their assignment authorization forms with the BTU-TSP. Pursuant to such authorization, the Board shall deduct such annual sum as authorized in equal payments from the employee’s regular salary check, beginning with the salary check received by the employee in the month following the date of authorization. Deductions shall be made from those checks designated by BTU-TSP during the fiscal year. Such authorization shall continue in effect from month to month thereafter, unless revoked by the employee in writing to the BTU-TSP and to Human Resources & Equity, not less than thirty (30) days prior to the next payroll cutoff date. The deductions shall be remitted not less frequently than monthly to the BTU-TSP. The right to such dues deductions shall be granted exclusively to the BTU-TSP and shall not be granted to any other employee organization seeking to represent employees in the bargaining unit. The BTU-TSP shall notify the Division of Human Resources & Equity of the amount of any change in annual dues to be deducted no later than the last workday of the month prior to the month in which such change becomes effective. The BTU-TSP agrees to indemnify and hold harmless the Board, each individual Board member, and all administrators against any and all claims, costs, suits or other forms of liability and all court costs arising out of the application of the provisions of this section.

A member of the Union or an employee who has applied for membership may sign and deliver to the Union a signed form authorizing the payroll deduction of dues, deduct BTU-TSP duesassessments, and/or contributions to the Union and/or its PAC. The BTU-TSP Union shall furnish, distribute and process assignment be responsible for delivering the authorization forms, said forms to be filed the District. Such authorizations shall continue in effect from year-to- year unless revoked in writing by BTU-TSP with Human Resources & Equitythe member under procedures administered by the Union.
2. Employees The District shall process payroll deduction forms received from new employees no later than the second pay cycle after receipt.
3. Current employees who desire wish to become members of the BTU-TSP shall file their assignment authorization forms switch to payroll dues deduction may only do so effective with the BTU-TSPstart of a new school year (first paycheck in September).
4. Pursuant to such authorization, the Board District shall deduct such annual sum dues, assessments, and/or contributions in consecutive and equal amounts from the regular salary checks of the bargaining unit member starting with the first paycheck in September so that the total amount is deducted by the second paycheck in June (20 pays). It is understood that in some individual situations (e.g. a member on leave), the deduction amount may change during a given year and/or there may be less than 20 pays for an individual.
5. Such deductions shall not supersede any legally required deductions.
6. The Union shall certify to the district payroll office in writing before August 1 (or as soon as possible for Union members submitting new authorization forms) the total amount to be deducted for each member who has submitted the authorization for payroll deduction.
7. Upon receipt of authorized in equal payroll deductions for dues, assessments, and contributions to the Union and/or its PAC, the District shall transmit these payments from to the Michigan Education Association via provided ACH within 10 business days of when the payroll deductions took place.
8. Accompanying the distribution of payments will be a report indicating the specific categorical amounts attributable to each employee with the employee’s regular salary check, beginning with the salary check received by the name and employee in the month following the date of authorizationID number. Deductions This report shall be made from those checks designated by BTU-TSP during the fiscal year. Such authorization shall continue in effect from month to month thereafter, unless revoked by the employee in writing provided to the BTU-TSP Union within 10 business days.
9. In the event of any legal action against the District brought in a court or administrative agency because it complied with this Section, the Union agrees to defend such action, at its own expense and to Human Resources & Equitythrough its own counsel, not less than thirty (30) days prior provided:
a. The District gives timely notice of such action to the next payroll cutoff dateUnion and permits the Union intervention as a party if it so desires.
b. The District gives full and complete cooperation to the Union and its counsel in securing and giving evidence, obtaining witnesses, and making relevant information available at both trial and appellate levels.
c. The Union shall have complete authority to compromise and settle all claims which it defends under this section.
10. The deductions shall be remitted not less frequently than monthly to the BTU-TSP. The right to such dues deductions shall be granted exclusively to the BTU-TSP and shall not be granted to Union agrees that in any other employee organization seeking to represent employees in the bargaining unit. The BTU-TSP shall notify the Division of Human Resources & Equity of the amount of any change in annual dues to be deducted no later than the last workday of the month prior to the month in which such change becomes effective. The BTU-TSP agrees to action so defended, it will indemnify and hold harmless the Board, each individual Board member, District from any liability for damages and all administrators against any and all claims, costs, suits costs imposed by a final judgment of a court or other forms of liability and all court costs arising out administrative agency as a direct consequence of the application of compliance with this Section, but this does not include any liability for unemployment compensation paid under the provisions of this sectionMichigan Employment Security Act.
