Common use of Parks and Open Spaces Clause in Contracts

Parks and Open Spaces. Any parks and open spaces within this Plan or the vicinity may or may not include future facilities for active and/or passive recreational use. The decision will be at the sole discretion of the Town of Ajax. as Purchaser of Lot Plan from ▇▇▇▇ ▇▇▇▇▇ Developments Ltd. as Vendor hereby requests to change a previously selected colour chart or standard item as set out below. The Purchaser acknowledges that the Vendors only obligation is to install the original selection and the requested change may not occur. The Vendor will attempt to complete this change, but if for whatever reason and regardless of fault or cause such change is omitted, the Purchaser shall be credited with the amount the Purchaser paid for it and such credit shall be the limit of the Vendor’s liability.
