Common use of Parent Access Clause in Contracts

Parent Access. The LEA shall establish reasonable procedures by which a parent, legal guardian, or eligible student may request the opportunity to inspect and review Student Data in the student's records, and seek to amend Student Data that are inaccurate, misleading or in violation of the student's right of privacy. Contractor shall respond in a timely manner (and no later than 45 days from the date of the request) to the LEA’s request for Student Data in a student's records held by the Contractor to view or correct as necessary. In the event that a parent of a student or other individual contacts the Contractor to review any of the Student Data accessed pursuant to the Services, the Contractor shall refer the parent or individual to the LEA, who will follow the necessary and proper procedures regarding the requested information.

The Provider shall use reasonable efforts to respond within 45 days to any reasonable written request the opportunity to inspect and review by XXX for Student Data in the student's records, and seek to amend Student Data that are inaccurate, misleading or in violation possession of the student's right of privacy. Contractor shall respond in a timely manner (and no later than 45 days from the date of the request) to the LEA’s request for Student Data in a student's records held by the Contractor Provider to view or correct as necessarynecessary where XXX is not able to do so on its own through the Services. In the event that a parent of a student or other individual contacts the Contractor Provider to review any of the Student Data accessed pursuant to the Services, the Contractor Provider shall refer the parent or individual to the LEA, who will follow the necessary and proper procedures regarding the requested informationStudent Data.”

In the event that a parent of a student pupil or other individual contacts the Contractor Provider to review any of the Student Data accessed pursuant to the Services, the Contractor Provider shall refer the parent or individual to the LEA, who will follow the necessary and proper procedures regarding the requested information.
