Common use of Ownership of Footprint Projects Clause in Contracts

Ownership of Footprint Projects. (a) Each Footprint Project shall be owned by the Party that funded the capital expenditures used to construct such Footprint Project; provided however, that any part of the ERCOT Transmission Assets that is built with CIAC funds shall be considered a leasehold improvement that is part of the ERCOT Transmission Assets and shall revert to the Lessor upon termination of this Agreement without further payment from Lessor to Lessee under Section 2.3.
