Owner’s Representative's Evaluation. Owner’s Representative will, at least two (2) calendar days before the bid opening, make a determination in writing to the Contractor, in the form of an addendum, whether or not the substitute item will be acceptable. Owner’s Representative will be the sole judge of acceptability. No "or-equal" or substitute will be ordered, installed or utilized without Owner’s Representative's prior written acceptance. Owner may require Contractor to furnish at Contractor's expense a special performance guarantee or other surety with respect to any "or-equal" or substitute.
