OWNER’S INTENT. 1.1.1 The Owner desires to obtain from the Engineer professional services necessary for the design and construction of various projects requiring engineering services in Volusia County, Florida, the estimated total construction cost of each individual project not to exceed $1,000,000.00. 1.1.2 The Owner does hereby contract with the Engineer for a term of one calendar year, expiring December 31st of the following year from the date above, to perform the above-described services, and other required professional services on an as-needed basis, as designated, authorized and/or assigned by the Owner, and the Owner agrees to compensate the Engineer for such services in accordance with the provisions contained in this Agreement. 1.1.3 The Owner may, at the Owner's option, at a regular or special board meeting, renew this Agreement. 1.1.4 It is understood that the primary intent of this document is to assure that the Owner has the Engineer "on call" with prior, mutually agreed upon conditions of service, and that the Owner has complied with all requirements of the Consultants Competitive Negotiations Act, in the selection of the Engineer and in negotiations for this Agreement. 1.1.5 The Engineer acknowledges that it has a professional duty of care in the performance of its duties under this Agreement. The Engineer will exercise its best efforts to ensure faithful performance of the Construction Agreement by both the Owner and Contractor.

OWNER’S INTENT. 1.1.1 The Owner desires to obtain from the Architect professional services necessary for the design and construction of ▇▇▇▇▇▇▇ Elementary, Replacement School, Project No. 164519, hereinafter called the Project. 1.1.2 The Architect acknowledges that it has a professional duty of care in the performance of its duties under this Agreement. The Architect will exercise its best efforts to ensure faithful performance of the Construction Agreement by both the Owner and Contractor.
OWNER’S INTENT. The Owner desires to obtain from the Construction Manager services necessary for the construction of various projects requiring construction management services in Volusia County Florida, the estimated total construction cost of each individual project not to exceed four million dollars ($4,000,000) or an amount in accordance with applicable law. The parties intend the Contract to include all labor, equipment and materials reasonably necessary for the proper completion of the Work. All Work to be in accordance with the plans, specifications and applicable law and codes. The Owner does hereby contract with the Construction Manager for a term of two (2) years, but in any event expiring the thirtieth day of June of the second year from the date above, to perform the above described services, and other required services on an as-needed basis, as designated, authorized and or assigned by the Owner. The Owner agrees to compensate the Construction Manager for such services in accordance with the provisions contained in this Agreement. The Owner may, at the Owner's option at a regular or special School Board meeting, renew this Agreement in single year increments not to exceed applicable law.
