Overloaded Containers Clause Samples

Overloaded Containers. No commercial container, dumpster, or roll-off container should be overloaded to the point where the lid or covers will not close, or the tarp will not properly cover the load. Contractor may decline to empty an overloaded container until the Customer unloads the dumpster or roll-off container to the point where the lid(s) will close, or where the load may be safely tarped prior to transport.
Overloaded Containers. If FRANCHISEE determines that a container is repeatedly filled beyond capacity, FRANCHISEE shall attach a notice to the (1) the service location, and (2) date of the infraction. FRANCHISEE shall not refuse to collect from container unless it previously: (1) attached a warning notice to the container and (2) gave a copy to the County.
Overloaded Containers. Contractor may refuse to Collect overloaded Containers, or may Collect them as a Special Service pursuant to Section 8.8. A Bin is deemed to be overloaded if Solid Waste protrudes more than one (1) foot above the surface, and a Rolloff Box is deemed to be overloaded in the same circumstance or if transporting it would cause Contractor to be out of compliance with Applicable Laws.
Overloaded Containers. Are subject to additional charges, including tip fees.
Overloaded Containers. A driver must make the dispatcher aware if the container appears to be overloaded by the customer before transporting the container. Where a container has been overloaded and the combined weight is over the GVW, the driver has the right to refuse to pull that container. The Company agrees to pay for an overweight ticket if it can be shown that the Company is responsible.
Overloaded Containers. Without prejudice to the foregoing, we may also charge you for dealing with any overloaded Container(s) or where the Maximum Weight per Container has been exceeded.
