OUTSIDE TRASH Clause Samples

The OUTSIDE TRASH clause establishes the responsibilities for the disposal and management of trash and waste materials outside a property or premises. Typically, this clause specifies which party—such as a tenant or landlord—is responsible for ensuring that garbage is properly collected, stored, and removed from designated outdoor areas, and may set standards for cleanliness or compliance with local regulations. By clearly assigning these duties, the clause helps prevent disputes over waste management, maintains property appearance, and ensures compliance with health and safety requirements.
OUTSIDE TRASH. ▇▇▇▇▇▇ agrees to keep the outside of the property free of trash, debris, and pet feces. ▇▇▇▇▇▇ agrees to follow the local ordinances for the disposal of garbage and trash. The City will furnish the Group with approved rolling trash containers. Trash must be stored inside these containers to reduce the likelihood of animals or wind dispersing trash around the neighborhood. If the Tenants produce more trash than fits inside these cans, the HM may purchase surplus trash disposal stickers from the City at a cost of $1 each. Excess trash can be stored in trash bags on top of the City provided containers and must have a visible City surplus trash sticker on each bag. These bags must be placed out for collection at the next trash day. Tenants are responsible for moving the trashcans from the storage area to curb for collection the evening before trash day. Tenants are also responsible for returning the empty cans to the storage area by the end of the trash day. If excessive loose trash and debris are noticed outside the property, Landlord will provide the first free written warning to the Tenants (See § 55). After 24 hours, ▇▇▇▇▇▇▇▇ will return to verify that the trash or garbage is securely contained inside trash cans and inside the trash can storage area. If loose or uncanned trash remains, Landlord will clean any remaining trash and the HM will be invoiced for the cleanup time and both inspection times. See § 61 for specific costs per Tenant if excessive trash is documented by the City as a violation.

It is the responsibility of the HM to purchase or obtain enough exterior trashcans with lids to serve the Group’s largest weekly trash output. All trash and garbage must be stored in trashcans in the storage area to reduce the likelihood of animals or wind dispersing trash around the neighborhood. Tenants are responsible for moving the trashcans from the storage area to curb for collection the evening before trash day. Tenants are also responsible for returning the empty cans to the storage area by the end of the trash day. If excessive loose trash and debris are noticed outside the property, Landlord will provide the first free written warning to the Tenants (See § 55). OUTSIDE TRASH. Castle Property furnishes a trash dumpster for the use only by the Tenants for the disposal of their household trash. Dumpsters may not be used for the disposal of furniture, commercial waste, auto parts, or other hazardous waste as defined by the Rockingham County Landfill and Waste Management. Tenants are required to remove all furniture from the property at the end of the lease. Castle Property offers furniture disposal service on Tuesdays for $45 for the first 3 items and $5 for each additional item. Tenant must register furniture pickups with the office by noon on Monday. Furniture placed in the dumpster or left outside without registration will be billed at $50 per item plus any fines received from Waste Management. Outside trash will be collected and disposed of as soon as it is discovered. Individual trash cans or bags may not be left outside any unit. If trash or recyclables are discovered in the common area, the items will be removed and the house manager for the offending property will be billed for the cost of removal, cleanup and any time needed to determine the source.
