OUTSIDE CONTRACTING. It is recognized and understood that at times and for varying reasons it is not considered practical or advisable for certain work to be performed in-house. The Company must, therefore, reserve the right to decide how and by whom any work is to be performed. This Article is not to be regarded as affecting that right. In the event that the Company finds it necessary to contract out work presently performed by the bargaining unit, it agrees to the following:

OUTSIDE CONTRACTING. Employee shall not enter into any agreements to provide programming or other services to any company, person or organization outside of his employment by Dendrite (an "Outside Agreement") without the prior written express consent from Dendrite. Employee must notify Dendrite of his intent to enter into an Outside Agreement specifying therein the other party to such Outside Agreement and the type of programming and/or services to be provided by Employee. Dendrite shall not unreasonably withhold permission to Employee to enter into Outside Agreements unless such Outside Agreements (i) are with competitors or potential competitors of Dendrite, or (ii) as determined in Dendrite's sole discretion, shall substantially hamper or prohibit Employee from satisfactorily carrying out all duties assigned to Employee by Dendrite.
OUTSIDE CONTRACTING. The District retains the right to subcontract work in the manner it has done so prior to this Agreement.
OUTSIDE CONTRACTING. 1. The District shall not contract out work customarily performed by Unit C employees if the result is in a reduction in force.
OUTSIDE CONTRACTING. It is not the intent of the Company to utilize outside contractors to perform work that can normally be done by Skilled Trades Employees. If the need to utilize outside contractors should arise, the company will whenever possible provide verbal notification to a skilled trade’s person. It must be understood that situations will arise where skilled trade’s employees will not be able to do the work required due to nature of work, timing, availability of personnel, etc. The company shall retain the right to determine when contracting-out is necessary. It is the sincere desire of the company to create harmonious relationships between management and union and not to limit the rights of the company to determine when outside contracting is necessary.
OUTSIDE CONTRACTING. The Board will not suspend the employment of or reduce the hours of employment of bargaining unit members as a result of the contracting out of bargaining unit work.
OUTSIDE CONTRACTING. This letter is written to confirm the Company's policy regarding the performance or maintenance of trades work with our own employees and equipment. It is recognized that at times and for varying reasons it is not considered practicable or advisable for certain work to be performed by our own Company. As in the past, the Company must therefore reserve the right to decide how and by whom any work is to be performed and this letter is not to be regarded as affecting that right; however, provided we have the necessary facilities and equipment and can perform the work required with our own work force in a manner that is competitive in terms of cost, quality and within projected time limits, it is our intention and desire to keep such work within the Company. Regular employees on layoff from the bargaining unit will have the opportunity to perform work that is to be contracted based on the conditions in the first paragraph, if the work to be contracted is greater than seven (7) calendar days in duration. It is recognized that recalling a regular employee for a short term (e.g. seven (7) calendar days) contract opportunity is not practicable for either the company or the individual in certain circumstances. Prior to such recall the parties will discuss issues surrounding such recall. This does not include employees covered under letter 32. In all cases, except where time and circumstances prevent it, the Company will notify the Union prior to letting a contract for the performance of maintenance work in order to afford the Union an opportunity to hold advance discussion of the matter before the contract is let.

OUTSIDE CONTRACTING. (1) It is agreed that, except in conformance with past practice and policy, no work regularly performed by Employees in the bargaining unit will be contracted out or be performed by any other employees.
OUTSIDE CONTRACTING. The following will confirm the Company policy regarding the performance of maintenance or trades work with our own employees and equipment. 76 It is recognized that at times and for varying reasons, it is not considered practical or advisable for certain work to be performed by our own Company. The Company must, therefore, reserve the right to decide how and by whom any work is to be performed and this Article is not to be regarded as affecting that right. If the Company has the necessary facilities and equipment and can perform the work required with our own workforce in a manner that is competitive in terms of cost, quality and within projected time limits, it is the Company’s intention and desire to keep such work within the Company. However, no skilled trades employee will be laid off while there is work available that he can perform within his classification. Prior to using outside contractors, the Company will first advertise, then exhaust all avenues, offering all available hours to the trades employees. When outside contractors are working at the Xxxx facility, bargaining unit employees in comparable classifications will be scheduled for at least the same number of hours as those worked by the outside contractor’s employees. In the event of a major layoff of Skilled Trades, the Company will retain the required Skilled Trades for any preventative maintenance program that is in effect. If the Company finds it necessary to contract out maintenance or trades work performed by its own employees, the Company will notify the Union in advance of such work being performed and the Company will describe the general nature of scope, including estimated trades and manpower involved, approximate dates within which the work is to be performed and why the service of outside contractor(s) is being contemplated at such time. The Union will be permitted to have members of the appropriate skilled trades attend any such meetings.
