Our Performance. We may appoint subcontractors, agents, affiliates, or partners to host, perform, modify, improve, enhance, or otherwise provide the Service Offerings or any components or portions thereof and to fulfill our obligations and exercise our rights under this Agreement. We shall be solely responsible for such third parties.
Our Performance. We represent and warrant that our services shall be performed in a professional and ▇▇▇▇▇▇▇ like manner and the computer servers will be operated in accordance with our obligations as defined by this Agreement.
Our Performance. So that you can see how we are doing, every month we will publish our performance against the Key Performance Indicators listed in appendix 1. Periodically we will also carry out surveys to understand your view on our performance. Please don’t wait for the survey though; you can feedback at any time by speaking directly to your Business Partner. We welcome your feedback and aim to respond to all feedback received.

You acknowledge and agree that we shall not be liable for any damages or loss of any kind resulting from any unintentional error or omission by us in performing Mobile Deposit, in accordance with or unintentional deviation from the terms and conditions of this Agreement, including exhibits or addenda. You acknowledge that our systems and procedures established for providing Mobile Deposit are commercially reasonable. Maintenance of Mobile Deposit or any related services may be performed from time-to-time resulting in interrupted service, delays or errors in Mobile Deposit or related services. Attempts to provide prior notice of scheduled maintenance will be made, but we cannot guarantee that such notice will be provided.

Therefore, we shall not be responsible for the timeliness, deletion, non-delivery, or failure to store any user data, communications, or personalization settings in connection with your use of the services. Further, we shall not be responsible for the operation, security, functionality, or availability of any wireless device or mobile network, which you utilize to access the services. You agree to exercise caution when utilizing the services on your personal computer or wireless device and to use good judgment and discretion when obtaining or transmitting information. Financial information shown on your personal computer or wireless device while using the services reflects the most recent account information available to us, but it may not be current.
