Other terms unenforceable Sample Clauses
The "Other terms unenforceable" clause establishes that if any provision within the contract is found to be invalid or unenforceable by a court or relevant authority, the remainder of the agreement will still remain in effect. Typically, this clause ensures that only the problematic term is disregarded or modified, while the rest of the contract continues to bind the parties. Its core function is to preserve the integrity and enforceability of the overall agreement, even if a specific part is legally challenged or struck down, thereby preventing the entire contract from being voided due to one unenforceable term.
Other terms unenforceable. The Broker may not require PSERS or any user of the Services acquired within the scope of this Agreement to sign, click through, or in any other way agree to any terms associated with use of or interaction with those Services, unless the PSERS has approved the terms in writing in advance under this Agreement, and the terms are consistent with this Agreement. Further, changes to terms may be accomplished only by processes set out in this Agreement; no quotations, invoices, business forms or other documentation, or terms referred to therein, shall become part of this Agreement merely by their submission to PSERS or their ordinary use in meeting the requirements of this Agreement. Any terms imposed upon the PSERS or a user in contravention of this subsection (e) must be removed at the direction of the PSERS and shall not be enforced or enforceable against PSERS or the user.
