Other Client Scope. 5.7.1 Prior to initiation of the Work, Client shall provide evidence of funds being available for paying the costs of this Project as further described in Section 2.2(a). In addition, Client shall have the affirmative obligation to pay all amounts due and owing to Contractor, in accord with these Contract Documents. Failure of Client to fund the Project or make payments as provided in this Agreement, shall be a material breach and entitle Contractor to stop Work and/or terminate as provided in this Agreement. 5.7.2 Client shall also provide the office furniture and office equipment for the services building, and lab and maintenance offices, tools and shop equipment (except any special tools required for equipment provided by Contractor), lab equipment and rolling stock.
