Common use of Other Applicable Legislation Clause in Contracts

Other Applicable Legislation. 26.1 At the Contractor’s sole discretion, if there are any disputes or claims for unpaid Materials and/or Works then the provisions of the Building and Construction Industry Security of Payments ▇▇▇ ▇▇▇▇ (New South Wales), and Building Industry Fairness (Security of Payment) ▇▇▇ ▇▇▇▇ (Queensland) may apply. 26.2 Nothing in this Contract is intended to have the effect of contracting out of any applicable provisions of the any of the Acts listed in clause 26.1 (each as applicable), except to the extent permitted by the Act where applicable.
