Opt-Out Termination. The terms set forth herein will be null and void, at Bangor’s option, if more than one percent (1%) of the Settlement Class Members opt out of the Settlement Classes. If Bangor elects to terminate the Settlement pursuant to this term, it must inform Class Counsel within ten (10) business days of learning that the Opt-Out Termination threshold has been reached.
