Common use of Operations Fire Clause in Contracts

Operations Fire. An “Operations Fire” is a fire caused by Contractor’s Operations other than a Negligent Fire. Forest Service, except as provided in B7.3, shall use cooperative deposits under B4.218 to perform fire suppression activities on Operations Fires. Contractor agrees to reimburse Forest Service for such cost for each Operations Fire, subject to a maximum of the dol- lar amount stated in A14. The cost of Contractor’s ac- tions, supplies, and equipment on any such fire pro- vided pursuant to B7.3, or otherwise at the request of Forest Service, shall be credited toward such maxi- mum. If Contractor’s actual cost exceeds Contractor’s obligation stated in A14, Forest Service shall reimburse Contractor for the excess.
