Operational Powers. The School shall be fiscally responsible for its own operations, and shall have authority independently to exercise the following powers (together with such powers as provided for elsewhere in this Contract and as allowed by the Act): contracting for goods and services; preparation of budgets; selection, supervision, evaluation, and determination of compensation for personnel; promotion and termination of personnel; leasing facilities for the School; accepting and expending gifts, donations, or grants of any kind in accordance with such conditions prescribed by the donor as are consistent with law and this Contract; and adoption of policies and Bylaws consistent with the terms of this Contract.

Operational Powers. The Network will be responsible for its own operations, and will have authority independently to exercise the following powers (together with such powers as provided for elsewhere in this Contract and under law, including the Charter Schools Act): contracting for goods and services; preparation of budgets; selection, supervision, evaluation, and determination of compensation for personnel; promotion and termination of personnel; leasing facilities for school purposes; accepting and expending gifts, donations, or grants of any kind in accordance with such conditions prescribed by the donor as are consistent with law and this Contract; and adoption of policies and bylaws consistent with the terms of this Contract. Any borrowing above five percent (5%) of the Network’s budget will be subject to prior District approval.

The School may negotiate and contract with a School District, the governing body of a state college or university, a school food authority, or any third party for the use, operation and maintenance of a school building and grounds, and the provision of any service, activity or undertaking that the School is required to perform in order to carry out the educational program described herein, subject to the Institutes’ prior right to review such contracts.

Operational Powers. Subject to the conditions and provisions of this Contract, the Forest Grove Community School through its Board of Directors shall be fiscally responsible for its own operations within limitations of any funding provided by the District and other revenues derived by the Forest Grove Community School consistent with law.
Operational Powers. Subject to the conditions and provisions of this Contract, TLCS, through its Board of Directors, shall conduct its operations subject to the direction and control of the District. The District will be fiscally responsible for TLCS’s operations. TLCS will retain the authority to be fiscally responsible for funding provided to TLCS via grant funds, and funds designated by the District for curriculum. TLCS’s authority over grant and curriculum funds is limited to objects consistent with the mission and purpose in the application. These funds will be maintained by the District. Any expenditures beyond those purposes must meet prior approval of the District.
