Operational Control and Crew Sample Clauses

The 'Operational Control and Crew' clause defines which party is responsible for managing and directing the day-to-day operations of a vessel or aircraft, including the selection, employment, and supervision of the crew. Typically, this clause specifies whether the owner or the charterer holds operational authority, and outlines obligations such as ensuring the crew is properly qualified, licensed, and compliant with applicable regulations. Its core practical function is to clearly allocate responsibility for safe and lawful operation, thereby reducing ambiguity and potential disputes regarding control and liability during the term of the agreement.
