The 'Open Escrow' clause establishes the requirement for the parties to initiate an escrow account as part of their transaction. Typically, this involves selecting a neutral third-party escrow agent who will hold funds, documents, or other assets until all agreed-upon conditions are met. For example, in a real estate transaction, the buyer deposits the purchase price into escrow, and the seller provides the deed, with the escrow agent releasing both only when all contractual obligations are satisfied. This clause ensures a secure and impartial process, protecting both parties by preventing premature release of assets and reducing the risk of default or fraud.
Open Escrow. Make sure you have all information necessary to give to the escrow officer and ask for one set of instructions to go to The Broker.
