Common use of Online Services Clause in Contracts

Online Services. For Online Services, Microsoft’s maximum liability to Institution for any incident giving rise to a claim will not exceed the amount Institution paid for the Online Service during the 12 months before the incident.

Online Services. For Online Services, Microsoft’s maximum liability to Institution Customer for any incident giving rise to a claim will not exceed the amount Institution Customer paid for the applicable Online Service during the 12 months before the incident.

Online Services. For Online Services, Microsoft’s maximum liability to Institution Customer for any incident giving rise to a claim will not exceed the amount Institution Customer paid for the Online Service during the 12 months before the incident; provided that in no event will Microsoft’s aggregate liability for any Online Service exceed the amount paid for that Online Service during the Subscription.

Online Services. For Online Services, Microsoft’s maximum liability to Institution for any incident giving rise to a claim will not exceed the greater of (i) twenty-four (24) times the monthly per-unit price (as set by the Reseller) for the individual named Online Services that gave rise to the liability or (ii) the amount Institution actually paid for the Online Service during the 12 24 months before the incident.

For Online Services, Microsoft’s 's maximum liability to Institution Customer for any incident giving rise to a claim will not exceed the amount Institution Customer paid for the Online Service during the 12 months before the incident; provided that in no event will Microsoft's aggregate liability for any Online Service exceed the amount paid for that Online Service during the Subscription.
