Ongoing Activities. Proposed actions that are nearing the completion of the NEPA process following the date this MOU is signed would not be subject to the MOU. This would include projects that are between the end of the final comment period and the signing of the Record of Decision. Each agency is encouraged to immediately begin implementing the conservation measures set forth in this MOU as appropriate and practicable.
Ongoing Activities. If Celgene had exercised its right to participate in Commercialization Activities in the North America Territory pursuant to Section 3.3.2, and if Celgene is engaged in such activities at the time the termination of this License Agreement becomes effective, [***] will have the right [***]. [***] shall exercise the foregoing right by providing written notice to [***] thereof prior to the date that is [***] after the effective date of such termination, stating that [***]. Ongoing Activities. (a) Services to Fluor Xxxxxx. Prior to the effective date of this ------------------------ Agreement, FDGTI provided Environmental Services to members of the Fluor Xxxxxx Group. Attached as Exhibit B is a summary of --------- substantially all of the ongoing projects in which FDGTI is providing Environmental Services to the Fluor Xxxxxx Group, including contract numbers and contact persons. From the effective date of this Agreement, and except as otherwise provided in Exhibit B, the terms and conditions previously agreed --------- to between the Parties for all projects ongoing shall govern. In the event the terms and conditions of this Agreement are not inconsistent with such previously agreed to terms and conditions, the terms set forth in this Agreement shall apply. The Steering Committee shall attempt to resolve any disagreements that may arise under this paragraph (a).
Ongoing Activities. If Pieris does not provide timely Continuation Election Notice (Section 19.3.4), then Roche (a) shall have the right to cancel all ongoing activities and (b) shall complete all non-cancellable activities at its own expense. If Pieris provides such timely Continuation Election Notice, then from the date of notice of termination until the effective date of termination, Roche shall, at Pieris’ request and expense, continue activities performed by or on behalf of Roche, including preparatory activities, ongoing as of the date of notice of termination. However, subject to Section 19.3.4, Roche shall not be obliged to initiate any new activities not ongoing at the date of notice of termination. After the effective date of termination and to the extent that Pieris has not made a request as described above, Roche shall not have any obligation to perform and/or complete any activities or to make any payments for performing or completing any activities under this Agreement, except as expressly stated herein.
Ongoing Activities. Licensor will, at Xxxxxxx’x election, wind down, complete or transfer to Xxxxxxx any Development activity relating to the Licensed Compounds and Licensed Products that is ongoing on the Effective Date, except that (a) Licensor will have the right to complete the activities set forth in Schedule 2.1.3 (the “Ongoing Pre-Clinical Studies”) and (b) Licensor will have the right to conduct the Phase 2 MS POC Study in accordance with Section 3.4. Promptly after completion of each Ongoing Pre-Clinical Study (and at any other time upon Xxxxxxx’x request), Licensor will deliver to Xxxxxxx all clinical and non-clinical data related to the Licensed Compounds and Licensed Products (including the raw tables, figures and listings datasets) generated from such study and all analyses and reports (including interim and final study reports) relating to any such data.

In June, seven Centers of Forest Protection in the territory extending from Tomskaya to Sakhalinskaya Oblasts completed placement of pheromone traps in the field and initiated yearly monitoring of Siberian moth populations. This is the 4th year of monitoring this major forest pest using the new labor-saving method. The total territory of 120 leskhoses is now monitored by using an area of only 65 thousand square kilometers. Also in June, field work started on the refinement of pheromones to differentiate among local populations of Siberian moth on Sakhalin Island and in Central Siberia. Sukachev Institute of Forest in Krasnoyarsk initiated the first stage in preparation of the field guide on Insect Pests of Forests. This volume is the last in a series of three field guides devoted to monitoring methods for insect pests and diseases of Russian forests. Ongoing Activities. In collaboration with Component 3, in June-July 2004, the FOREST biomass energy component is conducting a reverse trade mission bringing foreign company representatives, including those from the U.S., interested in buying Russian wood products together with their Russian counterparts in Siberia. U.S. companies seeking reliable supplies of high quality wood for use in high-value products, such as doors and windows, and U.S. manufacturers of biomass energy equipment could enter into commercial partnerships with Russian partners to supply equipment for the Russian market. Production of such high-value wood products requires effective biomass energy systems. • FOREST is cooperating with the Khabarovsk Ministry for Fuel and Energy and the Khabarovsk representative of the State Energy Supervision Department of Ministry of Energy of the Russian Federation (Gosenergonadzor) to promote biomass energy technologies in the region. • In response to the growing number of applications for technical assistance that the Component receives from small-sized companies in the wood processing industry for assistance with biomass boiler and kiln systems, FOREST formed a team of Russian experts to work on a cluster of such companies in SovGavan and Vanino (Khabarovskiy Krai). Experts gave recommendations on equipment selection adequate to the companies operation plans.
