Official Secrets. 28.1 In this Clause:

Official Secrets. Supplement to NEC3 TSC clause 27 27.20 The Contractor takes all reasonable steps to ensure that all persons employed by the Contractor or Subcontractors in connection with this contract are aware: 27.20.1 of the provisions of the Official Secrets Act 1989, and 27.20.2 of the provisions of the Atomic Energy Act 1946 (where appropriate) and 27. 20.3 that these Acts apply to them both throughout the duration and after the expiry or termination of this contract.

Official Secrets. These provisions draw the Contractor’s attention to the possible ramifications of the Official Secrets Act and the Atomic Energy Act.

Official Secrets. 1Without prejudice to the provisions of this clause 7, or to the operation of the Official Secrets Acts 1911 to 1989 ("the Official Secrets Acts") generally, the IAP is aware that GCHQ is a security and intelligence service and that, in particular, GCHQ's Confidential Information and any Protectively Marked Material are information relating to security or intelligence for the purposes of Section 1 of the 1989 Act and the IAP acknowledges that the Official Secrets Acts apply to them and will continue to apply to them in respect of any Confidential Information of GCHQ that is disclosed to them under this Agreement.

The Contractor shall take all reasonable steps by display of notices or by other appropriate means to ensure that all persons employed in connection with the Contract have notice that these statutory provisions apply to them and will continue so to apply after the expiry or early termination of the Contract. Contractor’s Personnel The Authority reserves the right to refuse to admit to the Authority’s Premises any person employed or engaged by the Contractor or its subcontractors, whose admission would be undesirable in the opinion (and at the discretion) of the Authority. If and when requested by the Authority, the Contractor shall provide a list of the names and addresses of all persons who may at any time require admission (in connection with the performance of the Services) to the Authority’s Premises, specifying the role in which each such person is concerned with the Contractor and giving such other particulars as the Authority may require. If and when requested by the Authority, the Contractor shall procure from each person identified by the request, a signed statement that they understand that the Official Secrets Acts 1911 to 1989 applies to them both during the carrying out and after expiry or termination of the Contract and that they will comply with the provisions of the Official Secrets Acts 1911 to 1989 in so far as they apply to the work/Services they are performing under the Contract. If and when requested by the Authority the Contractor agrees that it will submit any person employed or engaged by the Contractor or its subcontractors to the Authority’s security vetting procedure. The Contractor further agrees that any individual who refuses to submit to such vetting procedure or does not attain the clearance required by the Authority, will not carry out any work/Services on the Contract which the Authority certifies as suitable only for people who have passed its security vetting procedure. If the Contractor fails to comply with clauses (2), (3) or (4) of this Condition and the Authority decides that such failure is prejudicial to its interests, the Authority may immediately terminate the Contract by notice in writing to the Contractor, provided that such termination shall be without prejudice to any accrued rights of, or to any rights that shall accrue thereafter to, the Authority.
