Common use of NUMBER OF UTILISATIONS AND MAXIMUM AMOUNTS Clause in Contracts

NUMBER OF UTILISATIONS AND MAXIMUM AMOUNTS. 4.3.1 The Borrower may only deliver one Utilisation Request in any one month period (plus, if so required by the Borrower, an additional one Utilisation Request in not more than two separate months in each twelve month period) and may not deliver a Utilisation Request: (a) if at the date of the Utilisation Request the Total Facility Outstandings exceed the Maximum Permitted Outstanding Amount; or (b) if the Total Facility Outstandings will exceed the Maximum Permitted Outstanding Amount as a result of the proposed Utilisation on the proposed Utilisation Date; and (c) unless the proposed Utilisation Date is a Business Day falling within the Availability Period.
