Number of Units Delivered. Number of Units Ordered - MBO Units MBO Units will include: • Orders for Products made but not shipped because of industry wide shortages or other issues beyond the control of Wholesaler as demonstrated by Wholesaler to the reasonable. satisfaction of the MMCAP Infuse Managing Director, lead pharmacist, and lead financial representative (e.g., Manufacturer Unable to Supply, Manufacturer Allocations, Manufacturer Backorders, Manufacturer Recalls, and Manufacturer Discontinued). • Purchases of Products which exceed 150% of the previous month’s average demand per order. • Products ordered which are filled and delivered within twenty-four (24) hours of the original order. • Partial shipments if 75% or more of the order can be completely filled within 48 hours. • Unavailable Products repeatedly ordered within seventy-two (72) hours of the original order • Special orders requiring shipment from the manufacturer. • Non-stock Products that are not under contract with MMCAP Infuse. • Contract rolls/awards where notifications from MMCAP Infuse are received with less than 4 weeks’ notice prior to transition of addition (e.g., bid year transition). Wholesaler may only include Products in MBO Units for thirty (30) calendar days after notification.
