Common use of Notice to Nonacquiring Partner Clause in Contracts

Notice to Nonacquiring Partner. If it is not practicable to acquire Coal Properties in the Partnership name as contemplated by Section 13.2, within 14 days after the acquisition by any Partner or its affiliate of any interest or the option to acquire any interest in Coal Properties, the acquiring Partner shall notify the other Partner of such acquisition. Such notice shall describe in detail the acquisition, the real property and minerals covered thereby, the cost thereof, and the reasons why the acquiring Partner believes that the acquisition of the interest is in the best interests of the Partners under this Agreement. The acquiring Partner shall also make any and all other information concerning the acquired interest available to the other Partner.
