Common use of Notice of Certain Costs Clause in Contracts

Notice of Certain Costs. Notwithstanding anything in this Agreement to the contrary, to the extent any notice required by Section 1.11 or 2.05 is given by any Lender more than 180 days after the occurrence of the event giving rise to the additional cost, reduction in amounts or other additional amounts of the type described in such Section, such Lender shall not be entitled to compensation under Section 1.11 or Section 2.05, as the case may be, for any such amounts incurred or accruing prior to the giving of such notice to the Borrower.

Notwithstanding anything in this Agreement to the contrarycontrary contained in Section 2.13 of this Agreement, to the extent any notice required by Section 1.11 or 2.05 2.13 is given by any Lender more than 180 days after such Lender has actual knowledge of the occurrence of the event giving rise to the additional cost, reduction in amounts amounts, loss or other additional amounts of the type described in such SectionSections, such Lender shall not be entitled to compensation under Section 1.11 or Section 2.05, as the case may be, 2.13 for any such amounts incurred or accruing prior to the 181st day prior to the giving of such notice to the Borrower.

Notwithstanding anything in this Agreement to the contrary, to the extent any notice required by Section 1.11 4.1, 4.3 or 2.05 4.6 is given by any Lender more than 180 days after such Lender has knowledge of the occurrence of the event giving rise to the additional cost, reduction in amounts amounts, loss, tax or other additional amounts of the type described in such SectionSections, such Lender shall not be entitled to compensation under Section 1.11 4.1, 4.3 or Section 2.054.6, as the case may be, for any such amounts incurred or accruing more than 180 days prior to the giving of such notice to the Borrower.
