Normal Wear. This warranty will not cover repair where normal use has exhausted the life of a part or Power System. Power Systems, like all mechanical devices, need periodic parts replacement and service to perform well. The service life of any Power System is dependent on the care it receives and the conditions under which it has to operate. Some applications are very dusty or dirty, which can cause excessive wear. Such wear, when caused by dirt, dust or other abrasive material which has entered the Power System because of improper maintenance, is not covered by warranty. Coolant heaters will be covered for a period of one year from date of start-up. This warranty does not apply to starting batteries, proper fuel supply, and damage due to improper installation, external causes or scheduled maintenance Owner's Responsibilities The owner is obligated to install, operate and maintain the Power System in accordance with the recommendations published by CPG, including, without limitation, operating within the power rating designation. The owner is responsible for the costs associated with such maintenance and any adjustments that may be required. All claims must be brought to the attention of CPG or an authorized distributor or its designated service representative within 30 days after discovery that the Power System fails to meet this warranty. The owner is responsible for payment of the following expenses that might be incurred as a result of a failure under the terms of this warranty: ▪ Rental equipment used to replace the equipment being repaired ▪ Telephone or other communication expensesLiving and travel expenses ▪ The premium costs for overtime labor requested by the owner ▪ The cost of air freight or other extraordinary expenses for shipment of parts over and above premium surface transportation ▪ Any other consequential or incidental amounts Miscellaneous Damages In no event is CPG liable for incidental or consequential damages. Even if an Unit is kept closed for protracted period there may be faults appearing for non-use. All structural factors are considered and taken into account before CC is granted. Hence, the appearance of minor faults at a time lag is natural. In spite of all that promoter will rectify all the defects for five years. These defects will not imply any fault on the part of the Promoter. Normal Wear. Tear for Interior Walls - The Lease between the Landlord and Tenant will approximately define normal wear and tear for interior walls as “If the walls become slightly dirty and/or scuffed and faded in certain areas, fading, peeling, or cracked paint, slightly torn or faded wallpaper, crayon marks, small nail holes in interior walls caused from hanging pictures”.
